By signing up to and using Devoli services, you accept the Fair Use Policy set out below.

It is important to us that all customers using our network are able to access our services at all times. For this reason, as well as to ensure the ability for us to provide a quality service, the Fair Use Policy outlined below applies to some of the services we provide.

For services subject to our Fair Use Policy, we may apply it, if it is in our reasonable opinion that your usage of our Services is excessive and/or unreasonable as detailed in the below paragraphs.

We have developed our Fair Use Policy based around our customer’s average usage of our services and we may monitor your account to check this policy is being followed.

If, in our sole opinion, your usage of our services is so heavy that it exceeds estimated use patterns over any month, or is inconsistent with normal usage patterns, then your usage will be considered excessive and/or unreasonable.

If your usage is excessive and/or unreasonable, we will contact you to advise you that you are in breach of our Fair Use Policy.  We may request that you stop or alter your usage to come within our Fair Use Policy.

If you do not change your usage after you have been asked to, the following steps may be taken, without notice to remedy the situation:

a. suspend or restrict your service;
b. apply charges to your account for the excessive and/or unreasonable element of your usage;
c. terminate your services with us.

If we, at our sole discretion, believe your usage of our services is adversely affecting the quality of the service received by any of our other customers the following actions may be taken without notice:

a. suspend or restrict your service;
b. apply charges to your account for the excessive and/or unreasonable element of your usage;
c. terminate your services with us.

If you are on a fixed term contract and termination occurs due to your inability to adhere to this Fair Use Policy, you may be liable for Early Termination Charges related to your account.
